Legal Aid funding is available for any problem that a prisoner experiences in prison that directly affects their treatment in the prison system ( This may differ for prisoners in open prisons who do civilian work)

Prison Law is arguably the most politically sensitive area of law, Successive governments and certain sections of the media have used sentencing policy, prison regimes and the early release schemes, as a means to stir up public feeling against individuals convicted of criminal offences. Unhelpful comparisons are often made between victims of crime and offenders. The reality is, there are far too many people in prison, including children, and crowded prisons do not work.

Recent successes that we have had in our Prison Law Department :


Possession of a mobile telephone

In August 2009 in an independent adjudication we successfully argued that the client was not in possession of the mobile phone and the co defendant was convicted.


Recategorisation

In relation to a recategorisation, we argued that the prison was not reasonable in their decision to decline downgrading category status. The Legal Services Commission has granted limited legal aid in order for us to possibly take their decision on Judicial Appeal.


Parole

After 7 years in custody and a third application for parole, our client was successfully released. We argued that any potential risk was low enough to be managed in the community
